Please read these Terms of Use ("Terms") carefully before using the Orka mobile application (the "App") operated by Orka ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Use of the App

Orka is a language learning application that helps you learn vocabulary through video content, flashcards, and AI-powered explanations. You may use the App for personal, non-commercial purposes only.

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to the App or its systems.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App to distribute malware or harmful content.
• Reproduce, distribute, or create derivative works based on the App.

Account

You may create an account using Sign in with Apple or use the App without an account. You are responsible for maintaining the security of your account and for all activities that occur under your account.

Subscriptions and Payments

Orka offers an optional subscription ("Orka Pro") that provides access to premium features. By subscribing, you agree to the following:

• Payment: Subscriptions are billed through Apple's App Store. All payments are processed by Apple and subject to the Apple Media Services Terms and Conditions.
• Free Trial: We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
• Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies.

Intellectual Property

The App, including its design, code, content, and features, is owned by us and protected by intellectual property laws. Video content displayed in the App is sourced from third-party platforms and remains the property of its respective owners.

User-Generated and Third-Party Content

The App displays an ongoing feed of short videos sourced from third-party platforms (such as YouTube). This content is created by third parties and does not represent the views of Orka.

There is zero tolerance for objectionable content or abusive behavior. By using the App, you agree that you will not engage with the App to promote, request, or distribute content that is illegal, hateful, harassing, violent, sexually explicit, or otherwise objectionable, and you acknowledge that such content is strictly prohibited.

To keep the community safe, the App provides tools that let you:

• Report any video you find objectionable, directly from the feed.
• Block a video or creator, which immediately removes that content from your feed.

We review all reported content and will remove objectionable content and, where applicable, eject the responsible content provider within 24 hours. We reserve the right to remove any content and to terminate access for users who violate these Terms.

AI-Generated Content

The App uses artificial intelligence (OpenAI) to generate word explanations and translations. AI-generated content is provided for educational purposes only and may not always be accurate. We do not guarantee the correctness of AI-generated explanations.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
